An Ado-Ekiti Chief Magistrate’s Court on Monday witnessed a mild drama when a witness, Francis Ajayi Olowoyeye, recanted his deposition on his statement on oath while under cross-examination.

He came to testify in support of a 57-year-old Sunday Adetolaju, who was charged to court by the Police for illegally installing himself as “Obaru Adimula” of Irorin Quarters in Ilawe.

Adetolaju was also slammed with a charge of illegally parading himself as a king by wearing crown and royal regalia and also installing chiefs without being a prescribed authority and without the consent and permission of the prescribed authority, the Alawe of Ilawe, Oba Adebanji Ajibade Alabi.

Also charged alongside Adetolaju are four persons he illegally installed as chiefs: Rufus Ayo Olaniyi (52), Lucas Adubu (50), Rufus Asubiaro (58) and Florence Ojuko (50).

The accused persons, according to the charge sheet, committed offences contrary to Sections 12 and 15 of the Chiefs Law Cap C5 Vol 1 Laws of Ekiti State 2012.

Prosecution counsel was the Officer in Charge of Legal Department, Ekiti State Police Command, Mr. Femi Falade while the defence counsel is Mr. Taiwo Ogunmoroti.  Chief Olubunmi Olugbade held watching brief for nominal complainant (the Alawe).

Under cross-examination from Falade, the witness, Olowoyeye when confronted with his sworn affidavit told the court that he resides at Corpus Christi College area, Adin Quarters, Ilawe.

His latest testimony was contrary to what he told the court on the last day of sitting, August 7 that he resides at Number 2, Ijewi Street, Irorin Quarters, Ilawe.

Olowoyeye told the court that Alawe was installed in December 2011 but was confronted by the prosecution counsel with documentary evidence which showed that Alawe was appointed in November 2011 while Ororin was appointed December of the same year.

Contrary to his evidence, Olowoyeye was confronted with a letter signed by all quarter chiefs in Ilawe showing that appointment and installation of chiefs in Ilawe are uniform and guided by Ekiti State Chiefs Law.

Falade also confronted the witness with earlier approvals by the late Alawe to the immediate past Ororin and other chiefs in Irorin Quarters and other quarters in Ilawe.

Presiding Chief Magistrate, Mr. Adesoji Adegboye, adjourned the case to 27th October for further hearing.
