  • High Court Restrains Sacked Chairmen From Forcefully Taking Over LGs, LCDAs

The Governor of Oyo State, Engr. Seyi Makinde has alleged that the intention of the opposition All Progressive Congress (APC) in the state is to use the forceful take-over of  local government areas to prepare grounds for the declaration of ‘state of emergency’ in the state.

Governor Makinde disclosed this at Prof. Theophilus Ogunlesi Hall, venue of the Tax Stakeholders Summit held on January 28th, 2020.

He stated that all attempts to truncate his government since eight months ago have been abortive.

“Their intention is to truncate our government, they went to the Supreme Court and they came with nothing. Now they have started the problem of local governments and LCDAs so that a state of emergency can be declared, they will also come back with nothing.”

Meanwhile, the High Court sitting in Ibadan has restrained the dissolved APC council chairmen from forcefully taking over council offices across the state.

Justice Mashood Abass presided over the four reliefs sought by the lead counsel to the state government, Dr. Akin Onigbinde (SAN).

The reliefs included an order of interim injunction restraining all the 68 dissolved chairmen from forcefully taking over of the councils or taking steps capable of breaching the peace in the state.

The court orders were in line with ex-parte motion filed by the state government in suit number I/78/2020.

Also joined in the suit included the Attorney General of the federation and Minister of Justice, Abubakar Malami, Inspector General of Police, Mohammed Abubakar, Commissioner of Police, Oyo State, Shina Olukolu and APC Chairman in Oyo State, Akin Oke.

They were restrained from taking steps that would cause a breach of peace by embarking on self-help to give effect to a letter dated 14th January 2020 with reference number HAGF/OYO/2020/VOL.I/1 issued by the Attorney General of the Federation to the sacked chairmen and the Inspector General of Police pending the hearing and determination of the motion on notice.
